Fines for not declaring agricultural and food inventories

Failure to comply with the obligation to report monthly on the inventories of agricultural and food products constitutes a contravention and is sanctioned with a fine from 5000 lei to 20000 lei

Law no. 105 of April 13, 2023 regarding the regulation of the method of reporting inventories of agricultural and food products (Official Gazette no. 321 of April 18, 2023) __________

WHO Economic operators in the agri-food sector:

• agricultural producers

• warehouse administrators

• processors at national level

• merchants // with the following exceptions:

  • traders who own sales structures with a sales area of up to 400 sqm inclusive, excluding the spaces intended for the storage, preservation and production of goods, offices and annexes

  • itinerant traders

  • merchants who carry out public food service activities

  • merchants who carry out sales activities in public areas

WHAT Agricultural and food products for which economic operators in the agri-food sector have the obligation to provide statistical data for stock records:

1. vegetables fruits;

2. cereals and cereal-based products;

3. oilseeds and oilseed-based products;

4. forage legumes;

5. certified seeds: cereals, rice, oleaginous and proteinaceous;

6. meat and meat products, canned and mixed meat;

7. milk and milk products;

8. milling and bakery products;

9. processed, processed, preserved vegetable-fruit products;

10. fats and oils;

11. water, including natural mineral water, spring water and all other bottled or packaged waters;

12. rice;

13. aromatic plants, salt and spices;

14. teas;

15. sugar;

16. honey;

17. yeast.

WHEN In order to ensure the traceability of agricultural and food products on the market, the economic operators in the agri-food sector have the obligation to provide statistical data for the record of stocks of agricultural and food products, once a month, until the 15th of the month for the previous month, to the Ministry of Agriculture and Rural Development.

HOW The Ministry of Agriculture and Rural Development is developing an IT system for collecting statistical data reported by economic operators in the agri-food sector.

HOW MUCH Failure to comply with the reporting obligation constitutes a contravention and is sanctioned with a fine from 5000 lei to 20000 lei.
